About these terms
These terms apply to your use of this website and to every booking you make with VP Holidays Tours & Travels, A.P. Road, Thirthahalli – 577432 (“we”, “us”). By using the website or confirming a booking you agree to them. If you do not agree, please do not use the website or book with us. Where we send you a written booking confirmation with different terms for your trip, that confirmation prevails for that trip.
Using the website
- The website is for personal, lawful use to find out about and enquire for our services.
- Do not misuse it: no attempts to hack or disrupt it, scrape it at scale, send spam or false enquiries, or impersonate anyone.
- Information on the site, including packages, itineraries, distances, travel times, timings, vehicle types and photos, is a guide. Distances and durations are approximate and depend on traffic, weather and road conditions. Photos are illustrative.
- We try to keep the site accurate and available, but we do not promise that it will be error-free or always online.
- Links to other websites are provided for convenience. We are not responsible for their content.
Enquiries, quotes and bookings
- Submitting a form, or messaging or calling us, is an enquiry, not a booking.
- A quote is based on the details you give us (dates, route, number of people, vehicle type). If those details change, the quote may change.
- A booking is confirmed only when we confirm it in writing (WhatsApp, email or message) and, where we ask for it, you have paid the advance.
- Quotes are valid for the period stated in them, and availability of vehicles, drivers and accommodation is not guaranteed until the booking is confirmed.
- Please give accurate names, phone numbers, pickup points and travel details. We are not responsible for problems caused by incorrect information.
Pricing and payment
- All prices are in Indian Rupees (₹). Taxes, including GST where applicable, are shown or explained in your quote.
- Unless your quote says they are included, the following are charged extra: toll fees, parking, inter-state or entry permits, driver allowance for night halts, extra kilometres or hours beyond the agreed limit, and waiting time beyond the free period for airport and railway pickups.
- Hotel, meal, entry-ticket, activity and guide costs are included in a package only if the package says so.
- An advance may be required to confirm a booking, and the balance is due as stated in your confirmation. We accept the payment modes we tell you about at the time of booking (for example UPI, bank transfer or cash).
- Fares on the website that are marked “from” or “starting at” are indicative. The confirmed price is the one in your written quote or confirmation.
Cancellations and refunds
Cancellation charges depend on the service and how close to travel you cancel, because we may already have blocked a vehicle and driver or paid for accommodation, permits or tickets. The charges that apply to you will be told to you in writing when you book. In general:
- If we cancel (for example, no vehicle available, or safety reasons), you get a full refund of what you have paid for the cancelled service, or, if you prefer, an alternative date or vehicle where possible.
- If you cancel, we refund what you have paid less the cancellation charges and any non-refundable costs we have already incurred for your trip. The earlier you tell us, the less is deducted.
- No-shows and late changes: if you do not turn up at the agreed time and place, or change plans at short notice, the booking may be treated as used and may not be refundable.
- Unused services: services you choose not to use after the trip has started are not refundable.
- Approved refunds are paid to the original payment method (or the account you tell us) generally within 7 to 10 working days.
To cancel or change a booking, message or call us as early as you can, using the contact details below. Cancellation takes effect from the time we receive and acknowledge your message.
Holiday packages and weekend trips
- The inclusions and exclusions in your confirmation define what is covered. Anything not listed is not included.
- We may adjust the order of sightseeing, timings or stops to suit weather, traffic, local closures, safety or temple and park timings. We will try to keep the overall experience the same.
- Some places, such as waterfalls, forest areas, ghats and trek routes, may be closed or restricted at short notice, especially during the monsoon. Entry rules and fees are set by the local authorities.
- If we substitute a hotel or service, we will offer one of comparable standard where possible.
- Activities such as trekking, swimming, river or water activities and visits to remote spots carry inherent risk. You take part at your own risk and must follow instructions from guides, staff and local authorities.
Vehicle rental and transfers
- Our vehicles are provided with a driver. Seating capacity is a legal limit: we cannot carry more passengers than a vehicle is registered for.
- Hire is charged on the basis stated in your quote (for example per day with a kilometre limit, or a fixed transfer fare). The hire period runs from the agreed pickup time and place until you are dropped back, including any waiting.
- Airport and railway transfers: please give your flight or train number. We monitor delays where we can and will keep the vehicle for a reasonable period, but extra waiting beyond the free period stated in your quote may be charged. We cannot guarantee arrival times where road, ghat, weather or traffic conditions delay the trip, so leave ample time to catch flights and trains.
- Routes, halts and driving hours must follow the law and safe-driving rules. Our drivers may refuse a route or request that is unsafe or unlawful, or continue only after a rest break.
- Itinerary changes during the trip that add distance or time are charged at the rates in your quote.
- If a vehicle breaks down, we will arrange a replacement or alternative as soon as reasonably possible. We cannot be responsible for consequential losses such as missed connections.
Passenger responsibilities
- Be at the agreed pickup point on time, and carry a valid photo ID for every passenger. For flights and some sites an ID is mandatory.
- Wear seat belts where fitted, and follow the driver’s safety instructions.
- No smoking, alcohol or illegal substances in the vehicle, and no carrying of unlawful or hazardous goods.
- Keep the vehicle clean and treat it with care. You are responsible for loss of or damage to the vehicle caused by you or your group, and for any cleaning charges needed after unusual soiling.
- Treat our drivers and staff, other travellers and local communities with respect. We may end a trip without refund for abusive, unsafe or unlawful behaviour.
- You are responsible for your belongings. Please check the vehicle before you leave it.
- Please tell us in advance about any medical conditions, mobility needs, elderly or very young travellers, or luggage requirements, so we can plan suitably.
Third-party services
Many parts of a trip are provided by independent businesses such as hotels, homestays, resorts, restaurants, guides, boat operators and ticketing counters. We arrange these on your behalf but they operate under their own terms, and we are not their employer or agent for the service itself. If a problem arises, we will help you raise it and seek a fair resolution.
Weather, roads and events beyond our control
The Malnad region has heavy rain, landslides, fallen trees, ghat-road closures, floods and fog, especially in the monsoon. Strikes, bandhs, curfews, government orders, accidents, breakdowns and other events beyond our reasonable control can also disrupt travel. If this affects your trip, we may change, shorten, delay or cancel the services, and we will do our best to offer alternatives. Where we cannot provide a service, we will refund what you have paid for that service, less costs we cannot recover. We are not liable for further losses arising from such events.
Our responsibility
We will provide our services with reasonable care and skill. Subject to the law, including your rights as a consumer under the Consumer Protection Act, 2019, which these terms do not take away:
- We are not liable for loss or damage that was not reasonably foreseeable, or for loss of enjoyment, business or income arising from delays or changes.
- We are not liable for the acts, faults or omissions of independent third-party providers, or for the loss of personal belongings, cash or valuables.
- Where we are held liable, our total liability for a booking is limited to the amount you paid us for that booking, except for death or personal injury caused by our negligence or anything the law does not allow us to limit.
- We recommend that you take travel and personal accident insurance. Our vehicles carry the insurance required by law, but this does not replace your own cover.
Content and intellectual property
The website’s text, design, logo, photographs, itineraries and code belong to us or our licensors. You may view and share links to pages for personal use, but you may not copy, republish, sell or commercially reuse our content without written permission. Information you send us remains yours, and you allow us to use it to provide the service as described in our Privacy Policy.
Governing law and disputes
These terms are governed by the laws of India. If you have a complaint, please contact us first so we can resolve it quickly. If we cannot resolve it informally, the courts at Shivamogga, Karnataka have jurisdiction, without affecting any right you have as a consumer to approach a consumer forum or other authority that has jurisdiction under law.
Changes and contact
We may update these terms from time to time. The “last updated” date shows the current version; a booking is governed by the terms in force when you made it. Questions about these terms:
